Lawyers
are exclusively authorized to give professional legal advice and to represent parties professionally
in all judicial and non-judicial and in all public and private matters (articles 1, 6 and 7 of the Law
on Lawyers). Two or more lawyers may establish a law
partnership in the
form of an ordinary or general partnership (article 10 of the Law on Lawyers). A
lawyer may be represented by an associate lawyer with power of representation working in his law office
before all courts and administrative authorities. If the presence of a lawyer is legally required, the
associate lawyer must have the power of substitution. An associate lawyer has the power of substitution
who has successfully passed the Liechtenstein law examination or an equivalent foreign law examination
(articles 6, 21, and 28 of the Law on Lawyers). Resident
European lawyers:
EEA citizens licensed to practice law in their home State may establish domicile in Liechtenstein as
a lawyer if they are registered on the List of Resident European Lawyers (articles 45 et seq. of the
Law on Lawyers). Resident European lawyers may engage
in legal relations
under the name of a law partnership they belong to in their home State, and they may also practice law
in the framework of a branch office of such a partnership (articles 10 and 51 of the Law on Lawyers). European
lawyers providing services in Liechtenstein: EEA citizens authorized to practice law in their home State
are admitted to practice law in Liechtenstein temporarily across national borders, subject to supervision
by the Chamber of Lawyers (articles 55 et seq. of the Law on Lawyers). Individual
representations (outside the EEA): Lawyers who are not EEA citizens may on an individual basis be admitted
by the FSA as a representative or defense lawyer of a party before a Liechtenstein court or administrative
authority, taking into consideration special circumstances (article 68 of the Law on Lawyers). The
Liechtenstein Chamber of Lawyers is constituted by all lawyers
registered on the List of
Lawyers and the List of Resident European Lawyers. The Chamber of Lawyers is a body under public law
and, to safeguard legality, is subject to overall supervision by the Government (articles 39 et seq.
of the Law on Lawyers). |
